The General Terms and Conditions of Sale can be found at any time at www.elegantfusion.eu/cgv.
These terms and conditions preside over all customer sales using the website.
Before the order can be processed, the customer declares to have read and accepted the General Terms and Conditions by checking the box "I accept the Terms and Conditions of Sale." These Terms and Conditions of Sale may be subject to change, but the version applicable to the customer’s purchase is that which is posted on the site at the time the order is placed.
To ensure that the customer understands the product that he or she plans on purchasing, descriptions of products offered for sale are provided on the www.elegantfusion.eu site. In particular, the www.elegantfusion.eu site provides descriptions and images of the merchandise. The selection and purchase of a product is placed under the sole responsibility of the customer.
Photographs and graphics displayed on the website www.elegantfusion.eu are intended to illustrate the proposed sale and are for illustration purpose only. The customer is invited to read the description of each product and discover its characteristics, notably to ensure that the customer has found his or her desired features and size.
Any order placed is contingent on the creation of a Customer Account.
A Customer Account can be created either during the ordering processes after confirming the Shopping Cart and proceeding to checkout, or by clicking on "My Account" which appears on all pages of the site.
The customer must enter a valid email address and create a password. The customer must then confirm the password. This information is confidential. The customer is solely responsible for any consequences linked to the use of his or her account until its deactivation.
To continue the registration process, the customer must provide his or her full name, mailing address, home phone number and/or cell phone number, and confirm his or her email address and password.
The customer must provide only accurate information and should update his or her information if any changes occur.
In the event of non-compliance by the customer of the terms of sale, of non-payment by the customer, or acts contrary to the interests of the Elegant Fusion brand, the ELEGANT FUSION Online Store has the right to, without notice or compensation, disable a customer’s account.
Any customer who wishes to disable their account must notify Customer Service by clicking on the page marked "Contact."
Any order placed on the www.elegantfusion.eu site represent the creation of a contract between the customer and the Elegant Fusion Online Store, and implies the customer’s irrevocable agreement, including but not limited to, the Terms of Sales.
By clicking on "Add to Cart," the customer may place products of his or her choice in the basket. For each selected product, the customer is asked to choose the color, size and quantity ordered. It is possible at any time, to view the contents of the cart and remove one or more products that have been selected.
By clicking on "Order," the customer is confirming the cart and will then be asked to sign-in or create an account on the www.elegantfusion.eu site. The customer is then prompted to choose the delivery method. Shipping fees are the responsibility of the customer.
The customer must confirm the accuracy of his or her account information, including shipping and billing information, and will then proceed to the payment process.
By clicking on "Payment," the customer acknowledges and accepts the sales conditions and confirms the payment. Until the payment is confirmed, the customer may at any point withdraw from the order. As part of the payment confirmation step, the customer must select a payment method from among the different choices.
As soon as the payment method is confirmed, the order will be recorded. Any order implies the customer’s acceptance of the product’s price and description as provided on the www.elegantfusion.eu site. The customer will instantly receive an email informing him or her that the order has been received. This email does not mean that the order has been approved, but that Customer Service is examining the order. After Customer Service has reviewed the order, the client will receive an email informing him or her that either the order has been accepted and is being processed, or that because of a legitimate reason, the order cannot be processed.
The transaction history between the ELEGANT FUSION Online Store and the customer can be accessed at any time on the website under "My Account".
The sale will be considered final only after the ELEGANT FUSION Online Store has sent the customer a confirmation email indicating the acceptance of the order and the ELEGANT FUSION Online Store has processed the payment in full.
Products sold in pre-order require special management. In the case of an order with products in stock and others in pre-order. This one will be shipped only in reception in our stocks of pre-ordered products.
Customers may track their orders on the www.elegantfusion.eu site, by contacting Customer Service on www.elegantfusion.eu/contact, or by calling 08 11 26 00 59 (cost of a local call within metropolitan France).
The price of each product is listed in euros on the www.elegantfusion.eu site. The price includes all taxes (value added tax and any other taxes applicable on the date of the order), but excludes shipping costs, which are shown separately.
The seller reserves the right to change the price of the products at anytime. The pricing policy applicable is that which is in effect on the site at the time of the customer's order.
The full amount must be paid when an order is placed.
The order can be paid:
• by credit card: Visa, Eurocard, Mastercard, AMEX.
• by a credit available on your account.
A direct debit from the chosen payment method will be made at the time your order is shipped. The ELEGANT FUSION Online Store reserves the right to suspend any order and its delivery in the case of either a credit card payment that is declined or an order that is not paid in full.
The risk of loss, damage, and deterioration of the products is transferred to the customer at the moment the order is delivered and accepted by the customer.
Any information provided during the ordering process is subject to data processing by the ELEGANT FUSION Online Store. The data processing is used to analyze the transactions and prevent credit card fraud. As part of this analysis, customer service may contact the buyer to collect additional information. The ELEGANT FUSION Online Store reserves the right to cancel a transaction in the absence of a response on behalf of the customer or if the analysis reveals any anomalies. Any payment made with a credit card is systematically audited when the delivery address for the order made on the ELEGANT FUSION Online Store is different from the home address registered with the customer’s bank. This verification step is likely to result in a delay of the order’s delivery date.
Any product purchased on the website can be delivered in metropolitan France from Monday to Saturday within two (2) to five (5) business days once the package is shipped. The delivery is dependant on the shipping method chosen:
• either by La Poste Colissimo Suivi which will be delivered to the address indicated by the customer.
• or in the Relais So Colissimo of your choice (post office, affiliated business, or Cityssimo).
Delivery to the rest of Europe is not yet available on the elegantfusion.eu site. Meanwhile, customer service is at your disposal to help find you a solution dependant upon your needs.
The customer has a period of three days to declare any abnormalities to the merchandise that may have occurred during the shipment process.
In the case of returns due to delivery error, all non-compliant products must be returned accompanied with the delivery slip to Retour ELEGANT FUSION / LOGVAD 59090 ROUBAIX CARIHEM PFC. The non-compliant product and the shipping fee will be refunded within 30 days of returning the item.
Products purchased by the customer will be delivered within a maximum of thirty days from the date of the order to the address specified by the customer when ordering on www.elegantfusion.eu site. If this period is exceeded, and is not justifiable by a case of force majeure, the customer may request the cancellation of the order in accordance with Article L. 114-1 of the “Code de la consommation” and obtain a refund for the amount paid at the time of sale.
Except in special cases where one or more products are unavailable, the merchandise ordered will be delivered in one shipment. Deliveries are made by an independent carrier.
• Order Cancellation
The customer is charged when the order is shipped. His or her account is not charged before sending the order.
If the customer wishes to cancel the order before it is shipped, he or she can contact customer service or fill out the contact form available on the website on the Customer Service page.
The customer may also refuse the package at the time of delivery.
• Returning merchandise
The customer, in accordance with the law of retraction, has a period of 15 days from the time of delivery of the products to return them to the ELEGANT FUSION Online Store in order to be reimbursed.
The customer may return products purchased within the specified period by including the postmarked date on the delivery slip. Returns are subject to the following conditions:
- The products must be returned in their original and complete condition, so that they may eventually be resold.
- An email to customer service should be sent to this address: firstname.lastname@example.org
- A Customer Return Authorization slip, is available on the website and after being properly completed, must be enclosed in the package with the product(s) returned and sent to the following address: Retour ELEGANT FUSION / LOGVAD 59090 ROUBAIX CARIHEM PFC.
The ELEGANT FUSION Online Store recommends that customers choose a shipment method that includes package tracking in order to avoid inconveniences such as loss or theft of the products during shipment.
The amounts paid by the customer, including delivery charges (for a complete order return) will be fully reimbursed by bank transfer to the bank account specified by the customer within a maximum period of 30 days starting from the time that the right of retraction is evoked. The return costs are the responsibility of the customer.
The customer may choose if proposed by the ELEGANT FUSION Online Store, another method of reimbursement such as a credit to the customer’s account or a gift certificate.
In the case of a partial return of the products, the ELEGANT FUSION Online Store will not reimburse shipping insofar as the customer has benefited from the delivery service for items that are kept.
In the case of merchandise returned after the aforementioned period, the customer will not be refunded and will be informed that the products remain available at the warehouse for a period of one month. Upon the customer’s request, the products may also be reshipped to him or her.
The customer is informed that the information related to his or her orders is subject to automatic data processing.
Under the law 78-17 of January 6, 1978 the personal data provided by the customer for order processing is intended only for internal use by the ELEGANT FUSION Online Store. This personal data can still be transmitted to third parties and ELEGANT FUSION Online Store partners including the GF Diffusion company. Regarding the information about the customer, as provided by laws and regulations, the customer has the right to access, modify, and correct his or her information in the “My Account” section, and to lodge an objection by contacting customer service by phone at 08 11 26 00 59 or by email at email@example.com.
The data collection is intended to analyze transactions and prevent credit card fraud. The ELEGANT FUSION Online Store may require further written evidence of customer’s identity (ID in the name of the card holder, proof of address, etc.). In the event a customer refuses to provide such documents or information, the ELEGANT FUSION Online Store will cancel the order and refund the order.
Unpaid invoices due to fraudulent authorization of a credit card and incorrect or misleading statements made by the customer will result in the creation of a payment incident report, which is managed by the ELEGANT FUSION Online Store, containing data from the order including customer information.
French law governs these Terms and Conditions.
All disputes that may result from the Terms and Conditions, dependant upon their validity, interpretation, performance, termination, and their consequences or developments thereof, will be submitted to the competent courts under the conditions of common law.
All elements of the www.elegantfusion.eu site are operated by the ELEGANT FUSION Online Store and remain the exclusive property of the ELEGANT FUSION Online Store or its supplier.
At no time may the client or any other person who is not authorized to do so, reproduce, repost or use in any capacity whatsoever, even partially, any element of the aforesaid website.
Company names and product trademarks on the www.elegantfusion.eu site are protected under trademark law; reproduction or representation of all or part of these materials is strictly prohibited.
